Arguing for a secular state

By DR AHMAD FAROUK MUSA

Taking into consideration the significant non-Muslim community in our country, a secular state that embraces democracy is the most logical option.
TO many Muslims and especially the Islamists, the term secular is very repugnant. This abhorrence to anything secular stems mainly from the previously bitter experience of secularism in Turkey that had led to the dissolution of the Ottoman Caliphate, the last caliphate in the Muslim world.
The fall of the Ottoman Caliphate in the early 20th century led some Muslim scholars to push for a new entity known as an Islamic state to stem the onslaught of Western imperialism. Before that, the concept of an Islamic state was not known in the Islamic world.
History has shown that while secularism was born in the West, its values spread across the world in many different continents and societies.
According to Louay Safi, a scholar at the International Institute of Islamic Thought, secularism denotes a set of notions and values whose aim is to ensure that the state neither engages in promoting specific religious beliefs and values nor uses its powers and offices to persecute religion.
The Islamic state conundrum
Going by the current discourse in Malaysia, one gets the impression that the priority of an Islamic state is to impose a set of rules known as hudud. This obsession with hudud stems from the understanding that it is divine law in the Quran that is imposed upon believers.
Many people believe that hudud is a set of codified laws that can be imposed without resorting to human agency at all. This is an obvious fallacy since the Quran only lays down some basic texts that require human agency to interpret them.
The formulation, adoption and implementation of legislation are always matters of human judgment and reasoning. Therefore, their intended implementation is subject to human error and fallibility and can always be challenged and questioned. The problem will arise when such laws are deemed sacred and of God's divine will and any sort of criticism will be deemed as heresy.
On this matter, Prof Hashim Kamali has argued that hudud in the Quran is a broad concept that is neither confined to punishments nor to a legal framework. It provides a comprehensive set of guidelines on moral, legal and religious themes. Whenever the Quran specified punishments for the offences, it also made provisions for repentance and reformation. Whereas juristic doctrine has either left this totally out or reduced it to a mechanical formality that can hardly be said to be reflective of the original teachings of the Quran.
On another note, not only is hudud in direct conflict with the Federal Constitution but in the context of a multiracial and multi-religious society, such a proposition also raises the issue of whether the nation should be governed by two sets of laws: one for Muslims and the other for non-Muslims.
The real problem of having laws such as hudud is that it is presented as mandated by the divine will of God.
But Sharia must neither be privileged nor enforced as a source of state law and policy simply because they are believed to be the will of God.
Prof Abdullahi Ahmed An-Naim argued in “Islam and the Secular State” that the belief of even the vast majority of citizens that these principles are binding as a matter of Islamic religious obligation should remain the basis of individual and collective observance among believers. But that cannot be accepted as sufficient reason for the enforcement by the state because they would then apply to citizens who may not share that belief.
Why a secular state
Secularism does not mean the exclusion of religion from the public life of a society. The misconception that it does is one of the reasons many Muslims tend to be hostile towards the concept.
A state should be secular in the sense that it is neutral to all the differing religious doctrines. As Abdullahi An-Naim argued, the state neutrality is necessary for true conviction to be the driving force of religious and social practice, without fear of those who control the state.
A secular state must embrace democracy. And democracy cannot be based on Sharia law, as that on the contrary would denote a theocracy. A secular state would allow every living Muslim a true freedom. Freedom to pray and fast as he or she ought to, freedom to follow the footsteps of the Prophet as he or she sees fit and freedom to submit to the will of God as he or she understands it.
Mustafa Akyol in his book, Islam Without Extremes: A Muslim Case for Liberty, wrote a chapter on “Freedom to Sin”. In it, he argued that Muslims should rethink the meaning of the phrase “amarma'rufnahimunkar” or simply “commanding the good, forbidding the wrong”. They need to make a clear distinction between “crime” and “sin”. While combating crime can be made via legal means, sins should only be through civil means like preaching.
The argument does not arise from an antagonistic attitude against piety but from a true appreciation of what piety is all about: a sincere belief free from coercion. Any regime that imposes piety because of the belief that it is part of the doctrine “commanding the good and preventing the wrong” is basically creating a community of hypocrites than genuine piety.
Genuine piety only arises through personal choice. And that choice only becomes possible when there is freedom. In other words, freedom to sin is a necessary medium to be sincerely pious.
The erudite Muhammad Asad made it very clear when making his commentary in his magnum opus, The Message of the Quran, regarding verse 25 of al-A'raf or Faculty of Discernment, where he commented on the story about Adam and Eve's temptation. He said: “The growth of his consciousness symbolised by the wilful act of disobedience to God's command changed all this. It transformed him from a purely instinctive being into a full-fledged human entity as we know it a human being capable of discerning between right and wrong and thus of choosing his way of life. In this deeper sense, the allegory of the Fall does not describe a retrogressive happening but rather, a new stage of human development: an opening of doors to moral consideration. By forbidding him to approach the tree', God made it possible for man to act wrongly, and therefore, to act rightly as well. And so, man became endowed with that moral free will which will distinguish him from all other sentinel beings.”
The way forward
The arguments regarding this topic could go ad infinitum. However, one thing is very clear and that is we have to work on the best form of government that will be tenable to all the different races and religions in our country. With that in mind, we have to work on the best form of government that will be tenable to all the different races and religions in our country.
If we still want to continue fighting for an Islamic state, we have to agree on one basic fact. Not a single particular Muslim, whether the Grand Syeikh of al-Azhar or Saudi Mufti, could claim to have a theocratic authority.
Considering that Muslims have been divided into different sects, ideas and views, the only system that would be fair for all would be the one that would include all of them in the political process.
Taking also into consideration the significant non-Muslim community in our country who should never be considered as second-class citizens, then a secular state that embraces democracy is the most logical option. Secularism needs religion to provide a moral guidance for the community and, in turn, religion needs secularism to mediate the relations between the different communities that share the same political space and space of civic reason. Secularism is able to unite diverse communities of belief and practice into one political community simply because the moral claims it makes are minimal. And secularism is able to tolerate differing views in a religiously diverse community while maintaining its political stability.

‘Hudud can create tension’
By RUBEN SARIO
TheStar.com.my

KOTA KINABALU: An umbrella grouping of Chinese organisations in Malaysia has lashed out at PAS over its hudud proposal, saying such laws could lead to tension and miscarriage of justice.

Federation of Chinese Associa-tion of Malaysia (Hua Zong) president Tan Sri Pheng Yin Huah said though hudud would be enforced among Muslims, difficulties could surface in multi-cultural, multi-religious and multi-ethnic Malaysia.

If hudud were to be enforced, the question of which court has jurisdiction to hear cases would arise, he said.

“For example, if the accused is a Muslim, the case would be heard in the syariah criminal court.

“In that event, non-Muslim witnesses to the crime would not be allowed to testify.

“And, if the case is to be heard in the normal criminal courts, the accused can challenge the move, with the excuse that religion is supreme above everything else,” Pheng said at a dinner to mark the 28th national Chinese cultural festival at the Likas Sports Complex here yesterday.

Also present were Sabah Deputy Chief Minister Datuk Dr Yee Moh Chai and Health Minister Datuk Seri Liow Tiong Lai.

“We in Hua Zong firmly believe that the existing criminal administrative system, in accordance with the Federal Constitution that takes into account the interests of all communities, must be maintained,” said Pheng.

In this respect, he said, Hua Zong was relieved that Prime Minister Datuk Seri Najib Tun Razak had said the Government has no intention to implement hudud laws.

A letter that I got from a friend. Cheers!

------------------------------------------

Subject: Mikaeel (Murder) Conspiracy

Michael Jackson (MJ) was known as the most loving person in the world. He gave up most of his assets for charity and all his life, he fought for equality of the African Americans, AIDS victims, Against Drug Abuse, Against Abortion, Against Child Labor and secretly channelled his properties for the hungry children of the world. However, he wasn't peace at heart. He always think of himself as a child trapped inside a man's body. Being Peter Pan is all his dream, never to grow up, forever a child. That inspires him to build Neverland - a heaven for children. Children of all ages and races are welcomed to Neverland. MJ had so much love to give.

However, he made a mistake which he didn't know of the consequences. He saw the peaceful life his brother, Jermaine (Muhammad Abdul Aziz) had as a Muslim - true, Jermaine faced so much pressure that he moved to Bahrain .

In 1989, MJ made a press conference which shocked the world, "I have seen the Islam in the life of my brother, I have read the books about Islam. And I'd love to someday feel the calmness and peace of Islam...."

Since that, MJ's life was never the same again.
He was accused of so many accusations against child molestation. MJ was not someone who can deal with much pressure as he is a 'delicate child'. All the extortion and black mail followed after that. Everything he did was being seen as wrong in the eyes of the Media. All these are to influence his fans to hate MJ. If he is hated, then he would not be influencial anymore.

For several years, he stayed in England . Getting motivation from a long time friend, Cat Stevens, who had converted into Islam - named Yusuf Islam. From him, MJ learnt how Yusuf had survived being Muslim. He made friends with a song writer, Zain Bhikha too, who wrote a song titled, "GIVE THANKS TO ALLAH", which he wanted MJ to sing whenever he is ready.

Following his trial, MJ withdrew to Bahrain , where he was the special guest of sheik Abdullah bin Hamad Al Khalifa, the son of Bahrain ’s king. It was then that Michael began to give conversion more “serious thought.”
MJ stayed in Bahrain for approximately 3 years. He studied Islam, the prayers and learn to read the Koran (al-Quran).

Finally, he came back to Los Angeles and in November 2008 MJ had formally converted to Islam in a ceremony at a close friend’s house in Los Angeles .

He perform Haj with the King of Bahrain and son on December 2008.

He had a hidden agenda when he wanted to make a final comeback. He annouced in a press conference on March 2009, "This will be my final concert. I'll see you all in July...."

He planned that during his concert, he would announce that this is the FINAL concert as he wouldn't be performing anymore. He will declare that he is a Muslim and will only sing with Yusuf Islam and Friends.
At the end of the concert, he will be singing the song, "GIVE THANKS TO ALLAH" with Yusuf Islam. That is the reason why he chose London as his final concert venue instead of the USA . It was because he thought he could escape the USA 's extortion, and that he could perform with yusuf Islam who is in England .

At 12.30am, 25th June 2009, he hugged his production manager and said, "After reherasing for 2 months, I am finally ready for the concert..."
Before leaving to sleep, he waved his dancers, "It was a good night everyone. I'll see you all tomorrow..."
The next thing... He was pronouced dead at 2.26am....

When 911 was called, there are so much questions asked. It is as if they didn't know who MJ is and where he lived. The questions asked are more towards to delay time.
The hospital said the autopsy result can only be obtained after 2 months - very illogical as even the worst African technology could obtain the result in less than 2 weeks.

MJ's family members opt for second private autopsy as they started to feel something fishy is going on. The result came out in about 4 days - MJ was drugged with high dosage of anaesthetic - drug that brings about a reversible loss of consciousness, if used to much could stop the heart from beating.

Another result which was not aired in the media was, MJ's stomach is empty of this drug, but his blood were filled with it - same case as the death of Marilyn Monroe.
The private doctors also found many needle marks, afraid to be forced injections given to MJ on his bed.

In CNN Live after a week, Barack Obama was interviewed. And he said, "I love MJ, I grew up listening to his songs. It is a great loss, but rest assured that there is no conspiracy in his death..."
Now, why must a President made such statement before the official autopsy result came out? How would he know that there is no conspiracy without the post-mortem result? Seems like someone is afraid of his shadows.

MJ was known to the world as a person who is against drug abuse. Why must he be addicted to drug, then? If he wanted to commit suicide, why rehearse for his concert? And why will he want to see his dancers the next day?

Enough about his death. I am sure people around the world is not stupid anymore. These supreme power can fool us during the Marilyn Monroe conspiracy, Martin Luther King and Princess Diana. But in this MJ's case, they left too many loopholes for those who think...!!

MJ left us with this unfinished studio-recorded song, GIVE THANKS TO ALLAH. You can download this song here: http://www.filefactory.com/file/ahb80ff/n/Micheal_Jackson_-_Give_Thanks_To_Allah_mp3

MJ's family was about to give him a Muslim burial with the help of The Brotherhood of Islam. But, the CIA showed up at Neverland's door - blackmailed them that if they do so publicly, Katherine (MJ's mother) would be pull off from MJ's 3 children's custody as well as MJ's estates. Instead, they'll hire Debbie Rowe for the purpose, and the court will be in their favour. So much for democracy and fairness...

Finally, they agreed to let MJ have a Muslim Burial in Neverland. But in condition, must show to the public a Christian Memorial Service, as to prove to the world that MJ was never a Muslim.

So, Staples Centre was just a normal show. That's why the coffin was closed and sealed.

MJ was buried days earlier. The Gold Coffin was empty. They were about to bury the Coffin according to Christianity ways in Hollywood - as in their deal with the USA Government.

These happened, because the USA is afraid of the rising numbers of Muslims in the world.

FROM ME: WHY THESE CHRISTIANS AND JEWS SO AFRAID OF MUSLIMS? THEY SAID THAT MUSLIMS ARE WEAK, POOR AND LEFT BEHIND IN TECHNOLOGIES SO WHAT THEY AFRAID OF? WHY WITH ALL THESE REPUTATIONS, THERE'S AN INCREASING NUMBERS OF PEOPLE CONVERT TO MUSLIMS? WHY? THERE'S A HUGE NUMBERS OF PEOPLES IN US, UK, CHINA AND ALL OVER THE WORLD CONVERT TO ISLAM. BECAUSE THEY START BY HIDING THE REAL TRUTH IN BIBLE AND TAURAT (JEW'S SAY THAT THIS IS THEIR BIBLE) LONG TIME AGO. THE TRUTH IN THERE IS ASKING THE PEOPLE TO FOLLOW THE LAST GOD PROPHET THAT WAS MUHAMMAD. THE MUHAMMAD NAME WRITTEN IN THE REAL BIBLE AND TAURAT. THATS WHY THERE'S A LOT VERSIONS OF BIBLE BECAUSE THEY WANT TO HIDE THIS FACT. THEY JUST SO ARROGANCE TO ACCEPT THAT THE LAST PROPHET FROM ARABS NOT FROM THEM. WHY MOST OF WORLD PETROLEUM CAME FROM MIDDLE EAST ESPECIALLY MUSLIM COUNTRIES? IT WAS WRITTEN MORE THAN 1400 YEARS AGO IN QURAN THAT MUSLIM WILL BE GIVEN A "BLACK GOLD" TO USE FOR PROTECTION OF MECCA AND MEDINAH IN FUTURE. DID MUHAMMAD KNOW ABOUT THIS BLACK GOLD 1400 YEARS AGO? THIS IS ONE OF MANY PROOF THAT QURAN WORDS FROM GOD

WATCH OUT BLACK PROTON WAJA WNY4457
Good day to those who had a wonderful day, may those good time will be left on your sweet memory. But fuck hell yeah, for me this evening Friday,April 3rd 2009 pisses me off, some middle east fuck with his girl accomplice tried to put spell on me, they wanted to take money from me.

The story goes like this, I'm just getting ready to shoot of from the office. Suddenly got a call, my wife want me to hurry back pick her up because its late to pick up our son. So I rush to the building office lobby and then, there comes the rain. I though to myself 'naahh, this ain't gonna stop me, little rain wouldn't kill me'. Gripping my lappy bag and off to my car when suddenly a Proton Waja pulled in front of me. Door glass rolling down, a couple looks like from middle east slightly dark complexion asking me direction to KLCC. I politely told him the direction in the rain, then he ask for where can he find 'halal' food, I answered to him how he can know if its 'halal' food, simply just look for a halal certificate at the premise. Then he pull out his wallet, showing me large sum of foreign money notes and ask me where he can change this as he said he just came back from Singapore. He ask if I have some cash if he can exchange. So I told him there'll be money exchange in KLCC where he can exchange. He start pushes me to show what I have in my wallet. He really need to see if I have RM100 note. My heart suddenly being suspicious to this guy as he keep on pushing me for that RM100 note, his girl accomplice only sits back and didnt say a thing.

Then I thought 'fuck you', this kind of shit trick already happening in KL. I'm not gonna fall for that trick. I did take out my wallet and waive, and I said 'no RM100 inside' then I just walk off. The fucker just change gear and sped off.

Luckily, I'm still sane and took his car plate registration number. If you see this car, a black color PROTON WAJA with car registration plate WNY4457 do watch out!!!

Please bash the middle east driver and his girl friend and do make sure they'll eat from straw for the rest of their fuckin lives. If you are the owner of this car and rent it to this fuck couple, please get their details and report to the police now.
